Same-Sex Marriage Legal in CA! SCOTUS Rejects Prop 8

by Lane Florsheim

Same-sex marriage is legal in California!

On Wednesday morning, the Supreme Court voted 5-4 to not touch a lower court decision that found Prop 8 unconstitutional. Prop 8 banned marriage equality in the state of California, by providing that "only marriage between a man and a woman is valid or recognized" in the state.

From the majority opinion: "We have never before upheld the standing of a private party to defend the constitutionality of a state statute when state officials have chosen not to. We decline to do so for the first time here."

Perhaps the most surprising majority vote came from ultra-conservative Justice Antonin Scalia, who said "We have no power to decide this case. And if we did, we have no power to invalidate this democratically adopted" law.

What a completely awesome morning for gay rights. Hell, what a completely awesome morning for America.
